Harrison Bergeron Essay
Kurt Vonnegutââ¬â¢s fictional society adopted the theories of Social Contract and Social Justice to establish a new social and legal order. The people amended the constitution to attain equality for all. With the amendments, they created laws to make a uniform citizenry out of their people and in the process stripped them of their individuality. These laws were also intended to make them think and act alike which was their idea of equality. As to who is benefited from such extreme version of social control depends on whose viewpoint it was coming from. Despite their unrestricted freedoms no one was ultimately benefited in this kind of system. It was no guarantee of peace and absolute control, as in the case of Harrison. His physical and mental states were no match for the handicaps. Once both powers were unleashed and unrestrained what resulted was a blending and coordination that produced a beautiful symphony of dance and music. It was symbolical of the good things that can happen or that can be achieved if we let our natural gifts, talents and skills work for the common good. There can be unity in diversity and peaceful co-existence may be possible. In a controlled society as this fictional one, there were no norms, values, and culture that may identify them. For norms, values and culture were what will set them apart. This was a robotic society where the norms were that which are forced upon them because of the handicaps some were made to wear. Acceptable norms were absent because the standard (equality) was built into the system. In effect one had a common standard to follow in which to comport oneself, no less and no better that the others. There was only one value that stood, no one was above the other in appearance and in the treatment he gave and he got. Culture should define who and what this society was, but what would make it truly unique? There was nothing neither appealing nor interesting in it because everything went against the natural ways of man. People followed rules not out of their volition. How were they to know the good was turning bad, and worse was turning worst, if something in their brains signaled a censure. This restraint was basically against their good and benefit, but they had no choice but to obey what was programmed in their system. Once, this was a society that had reached the extreme end of the balance with their all-out freedoms and unchecked rights of individuals. The situation had reached unmanageable proportion that they had to resort to dramatic crisis control which brought them to the other extreme end by way of the encroachment on their rights and freedoms. This society took not only the peopleââ¬â¢s freedoms but their right senses as well. In what they figure to be the correct moves to effect change, their agitation towards a freak of nature was alarming, like when ââ¬Å"some things about living werenââ¬â¢t quite right â⬠¦ April not being Springtimeâ⬠(Vonnegut, 1961). Law and society have interchangeable attributes. Law may change a society and society may change the law. In the case of Harrison Bergeron, society had made 3 amendments to their constitution out of desire for and necessity to change. They wanted to regulate and curb freedoms to a comfortable magnitude. The change in the law made this society a strictly tempered one. Lawyers and the legal system do not have a place in this society anymore. The Handicapper General proceeded to punish without trial law breakers. The only crime that can be committed was taking oneââ¬â¢s handicaps off and that did not need investigation and defense. The crime and the criminal are self-evident. The fictional society does not have any direct similarities in todayââ¬â¢s time. However, the inference to the curtailment of freedoms is plenty. When a society does not allow an artist to express his heart in his art, the Harrison Bergerons to criticize the government which should be for, by and of the people, and ease the fear of ordinary citizens, they are the translations of Vonnegutââ¬â¢s transgressions of freedoms in his fictional society. Instead of seeking for equality in the extreme, working with diversity might be the better option.

Notwithstanding deceptive industry claims about the high quality and the health benefits of their products, in the 1920s and 1930s concerned nutritionists warned the public about the medical dangers of regular burger consumption. Currently, this skepticism and condemnation of fast food persists, extending even further to include ominous vigilance regarding the industry's use of genetically modified and antibiotic-laden beef products. In many major chains, these attacks have been countered by posting calorie and nutritional charts inside restaurants, advertising and claiming the use of fresh ingredients and presenting alternatives to their fried foods. Despite a few more health-conscious items on the menu, fast-food chains today assertively promote the idea that bigger is better, thus the emergence of such offerings as "super-size" or "biggie" portions of French fries, soft drinks, and milkshakes. Critics point to this marketing emphasis as a reason for an excessive and greatly increasing per-capita caloric intake among fast-food consumers, resulting in fast-growing rates of obesity in the United States and in many parts of the world. This is a discussion that surrounds misappropriation of trust funds by a trustee and focuses on the best legal advice to be given to the beneficiary. Introduction A trust is defined as an equitable duty that binds one person to handle property owned by him or her (but not his or her private property) on behalf of other persons in which any of these other persons my enforce the obligation; including the person himself or herself. This person is called a trustee while the others are beneficiaries and, as stated, the trustee could also be a beneficiary. The writer of the trust is called a settler. Hepburn insisted that o bligation is equitable1. Some scholars have clarified that the popular obligation of conscience is not necessarily the same as ââ¬Ëequitable obligation The prime obligation of a trustee is to run, handle and manage the trust on behalf of the beneficiaries. Over time however, it has been established that trustees could misappropriate the trust property; which led to the development of rules of equities to act as checks and balances. For instances, rules of equity stipulate that trustees cannot invest trust funds in their own private businesses but only beneficiary-authorized ventures. The beneficiaries are said to own the equitable interest in the trust fund or property and are required to demand for good management of the trust. Beneficiaries can sue trustees for mismanagement or breach of trust. The beneficiaries are entitled to proprietary interest emanating proceeding from the trust property or fund; and are entitled to pass it to others2. The beneficiaries have a legal duty t o terminate the trusteesââ¬â¢ legal titles to them. However, their age and absolute entitlement to the trust must be unquestionable. Jeremy Versus Kevin and Joint Trust In advising Kevin and the Joint Trust, there are a several features of a trust to be considered. It should be noted that the principle of equity is effected by the owner, trustee, in his or her own conscience. This is popularly known as implied or express trust. But if law comes in and forces the trustee to perform functions for which the property was conferred, that becomes a constructive. Using this power and the legal disposition discussed above, Kevin should go ahead and instruct his father to confer the legal title to him; otherwise seek courtââ¬â¢s direction. The second advice to Kevin would probably rhyme with the second feature of trusts: conscience. For all intends and purposes, Jeremy, the trusteeââ¬â¢s conscience is affected by at least some factors. This is illustrated by his decision to transfer the trust fund to his private account; which was of course not the original purpose of the trust. It means therefore that the trustee automatically rendered the trust from being implied or express. Establishment of a trust depends on a property that can be identified. In this case, Jeremy, by dishonestly transferring the trust fund, breached the trust and the ââ¬Ëproperty is not identifiableââ¬â¢3; thus a trust cannot be established and if it was prior established, it should end. Alternatively, since the trustee is already under constructive trust terms, through a court process, then he should be made to refund the trust fund. The image of the dog (a ââ¬Ëbull-dogââ¬â¢, in Mabelââ¬â¢s case) may, in its turn, be construed as a symbol for fear before the unknown fate. It is characteristic that it is no longer associated with Mabel, as she is depicted to be more resolute in the late parts of the story. For example, if a player have two strategies A and B the outcome resulting from A is better than that of B, then strategy A is said to dominate strategy B. A rational player will never choose to play a dominated strategy. In an extensive game, a strategy is a complete plan of choices, one for each decision point of the player. A mixed strategy is an active randomization, with given probabilities, that determine the players decision. The games are splitted as cooperative and noncooperative games. In a noncooperative game the participants cannot make commitments to coordinate their strategies, and hence the solution is a noncoopoerative solution. In a noncooperative game with finite players Nash equilibrium is a set of mixed strategies between two or more players where no player can improve his payoff by changing his strategy. Noncooperative games are defined by extensive and normal forms whereas cooperative games are presented in characteristic function form. In extensive form, games are often represented as trees and each node (vertex) represent a point of choice for a player. Each player is represented by a vertex. The lines out of vertex denote possible action for that player and the payoffs are specified at the bottom of the tree. In the normal form (or strategic form) game is represented by a matrix which tells strategies, players and payoffs. In general it is represented by any function that associates a payoff for each player with every possible combination of actions. In the normal form it is assumed that each player acts simultaneously without knowing the action of other. In cooperative games the individual payoffs of player are not known but the characteristic function gives the payoff of each coalition. For empty coalition the payoff is considered to be 0. In partition function form the payoffs not only depend on its members but also on the rest of players who were partitioned. In cooperative game participants can make commitments to coordinate their strategy which is a converse to noncooperative games. Cooperative games are particularly used in economics. In cooperative games if side payments (incentives) are allowed then the corresponding solution concept is known as transferable utility cooperative value otherwise it is known as nontransferable utility cooperative value.In game theory we have zero sum and non zero sum games. In zero sum games, the players gain or loss is balanced by other players losses or gains so that the total gains obtained when subtracted with total losses of the players gives a zero sum.
